Third Directive Order - Food and Beverage Expansion of Premises

Pursuant to the Emergency Declaration issued on March 23, 2020, with regard to the Town of Westerly, Rhode Island, effective immediately, I am issuing all licensed food and beverage operations in good standing with the Town of Westerly a "COVID-19 Temporary Expansion of Premises License" according to the following:

a. Such license is still subject to the standard show-cause petition process for any and all issues arising as a result of the use of a license within the Town of Westerly

b. Such licenses allow businesses to expand their operations to the exterior of their premises.

c. Such licenses do not exempt businesses from any public health and safety protocols, orders, or other such regulations, including but not limited to Social Distancing Requirements. 

d. Such licenses are still subject to all ordinary noise control ordinances and regulations. 

e. Such expansions may include area outside of the premises of the licensee so long as such area is immediately adjacent to the premises and all relevant parties with an interest in such adjacent land give written consent.

f. Such expansions may include public parks and public rights of way with the written consent of appropriate Town of Westerly Personnel and the Town Manager.

g. This order shall temporarily supersede all zoning requirements with regard to parking or other such special requirements placed on licensees.

This license is effective immediately and shall remain in effect until so long as the Governor of the State of Rhode Island maintains executive orders which have an impact of the seating capacity of food and beverage licensees as a result of COVID-19.
